These Terms of Service (“Terms”) govern your use of the website thrivepest.com (the “Site”) and all pest control, termite, and related services (the “Services”) provided by Thrive Pest Control (“Company,” “we,” “us,” or “our”), located at 7633 E 63rd Pl, Suite 300B, Tulsa, OK 74133. By accessing the Site or engaging our Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.
1. Services Provided
Thrive Pest Control offers residential pest control, termite inspections, termite treatment, bed bug inspection and treatment, mosquito control, rodent control, scorpion control, and related pest management services in the greater Tulsa, Oklahoma area, including Broken Arrow, Owasso, Bixby, Sand Springs, Jenks, Claremore, Collinsville, Pryor, Skiatook, Glenpool, Oologah, and Coweta. Specific services, treatment plans, and pricing are established through individual service agreements, estimates, or work orders provided to the Customer.
2. Estimates & Service Agreements
We offer free, no-obligation estimates. An estimate is not a binding contract until a service agreement or work order is accepted by the Customer and confirmed by the Company. Pricing in an estimate is valid for 30 days from the date issued unless otherwise stated. Actual service scope may differ from the estimate if conditions at the property differ from what was initially assessed; any changes will be communicated to the Customer before additional work is performed.
3. Recurring Service Plans
We offer monthly, bi-monthly, and quarterly pest protection plans that include interior and exterior treatment. If you notice pest activity between scheduled visits, contact us and we will return at no additional charge, subject to the terms of your plan agreement. Recurring plans are billed on the schedule specified in the applicable service agreement and may be canceled by either party with 30 days’ written notice. Early cancellation of a contract-term plan may be subject to fees as outlined in the service agreement.
4. Scheduling, Access & Customer Responsibilities
The Customer agrees to:
- Provide safe, reasonable access to the property and treatment areas at the scheduled time.
- Disclose known pest issues, structural concerns, or hazardous conditions on the property.
- Follow any pre-treatment or post-treatment instructions provided by our technicians (such as vacating the premises, securing pets, or covering food-preparation surfaces).
- Notify the Company of any known allergies, sensitivities, or health conditions that may be affected by pest treatment products.
- Ensure that individuals other than the Customer who may be present on the property (household members, tenants, visitors) are informed of scheduled treatments.
If a technician cannot safely access the property or the Customer is unavailable at the scheduled time, a trip charge or rescheduling fee may apply.
5. Treatment Results & Guarantees
While we strive for effective pest elimination and stand behind our work, pest control outcomes depend on many factors beyond our control, including property condition, environmental conditions, neighboring properties, sanitation practices, and the extent of infestation. Any guarantees or warranties on specific services are defined in the individual service agreement or work order for that service. No representation is made that a single treatment will permanently resolve a pest issue.
Bed bug treatments may require multiple visits due to the nature of bed bug egg dormancy and hatching cycles. The number of treatments and associated costs will be outlined in your treatment plan before work begins.
Important: Termite damage repair, structural remediation, and mold remediation are outside the scope of our pest control services. Our termite services address active infestations and prevention — not repair of damage already sustained.
6. Payment Terms
Payment is due upon completion of service unless alternative terms are agreed to in writing. We accept payment methods as communicated at the time of service. Past-due balances may incur late fees as permitted under Oklahoma law. We reserve the right to suspend or discontinue services for accounts with outstanding balances.
7. Cancellations & Rescheduling
We request at least 24 hours’ notice for cancellations or rescheduling. Failure to provide adequate notice or repeated no-shows may result in a service call fee. Recurring service plans have their own cancellation terms as outlined in Section 3 and the applicable service agreement.
8. Health, Safety & Chemical Disclosure
All treatments are performed by licensed technicians using products registered with the U.S. Environmental Protection Agency (EPA) and approved for use in the State of Oklahoma. Safety Data Sheets (SDS) for any products applied at your property are available upon request. While our products are applied in accordance with label directions and applicable regulations, no pesticide is entirely without risk. The Customer is responsible for following all post-treatment safety instructions provided by our technicians.
9. Limitation of Liability
To the fullest extent permitted by Oklahoma law:
- The Company’s total liability for any claim arising out of or related to our Services shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.
- The Company shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to property damage not directly caused by our negligence, loss of use, lost profits, or damage caused by pest activity after treatment.
- The Company is not responsible for damage to landscaping, plants, or lawn areas resulting from treatments performed at the Customer’s request or as part of an agreed treatment plan unless caused by a material deviation from product label instructions.
- Claims must be reported in writing within 30 days of the service date to be considered.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or any liability that cannot be excluded under applicable law.
10. Property Damage
Our technicians exercise care when accessing and treating your property. If you believe our Services caused damage to your property, please notify us in writing within 30 days. We will inspect the reported damage and work in good faith to resolve legitimate claims. Pre-existing damage, normal wear and tear, and damage caused by pest activity (as opposed to our treatment) are not the responsibility of the Company.
11. Website Use
The content on thrivepest.com is provided for informational purposes only. Pest identification information, treatment descriptions, and educational content on the Site are general in nature and do not constitute a professional inspection or diagnosis. All content, images, logos, and trademarks on the Site are the property of Thrive Pest Control or its licensors and may not be reproduced without written permission.
12. Privacy & Data Collection
We collect personal information (name, email, phone number, property address) through our contact forms and in the course of providing Services. This information is used to schedule and deliver Services, communicate with you, and improve our business. We do not sell your personal information to third parties. By submitting your information through the Site or during the course of service, you consent to our collection and use of that data as described herein.
13. Reviews & Testimonials
Customer reviews and testimonials displayed on the Site or in marketing materials reflect individual experiences and are not guarantees of results. We may feature reviews or feedback from third-party platforms in accordance with those platforms’ terms.
14. Dispute Resolution
In the event of a dispute arising from these Terms or our Services, both parties agree to first attempt to resolve the matter informally by contacting the Company directly. If informal resolution fails, any legal action shall be brought exclusively in the courts of Tulsa County, Oklahoma, and shall be governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.
15. Indemnification
The Customer agrees to indemnify and hold harmless Thrive Pest Control, its owner(s), employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from the Customer’s breach of these Terms, misuse of Services, or failure to follow treatment instructions, except to the extent caused by the Company’s own negligence.
16. Force Majeure
The Company shall not be liable for delays or failure to perform Services due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, government orders, or supply shortages.
17. Modifications to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms. For customers on recurring service agreements, material changes to these Terms will be communicated via email or written notice at least 30 days before taking effect.
18. Severability
If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with any individual service agreements, work orders, or estimates, constitute the entire agreement between you and Thrive Pest Control regarding the subject matter herein. In the event of a conflict between these Terms and a specific service agreement, the service agreement shall control.
